Upcoming Changes to Express Entry: LMIA-Based Job Offer

The Express Entry (EE) system is undergoing modifications by the Canadian government that may have an effect on the ranking and selection of immigration applicants for permanent residence. Candidates who obtain a job offer based on their LMIA will no longer be eligible for bonus points in the Comprehensive Ranking System (CRS) if these modifications are put into effect.

Potential Changes

During an interview on December 17, Minister Marc Miller revealed possible modifications to the CRS point calculation, in keeping with the Canadian government’s continuous attempts to increase equity and openness in the Express Entry system, Immigration, Refugees and Citizenship Canada (IRCC). He underlined how crucial it is to maintain the equity of the EE system for all applicants.

Fairness

“Removing the extra CRS points for candidates with an LMIA-based job offer would guarantee that people in the candidate pool are ranked exclusively on the basis of their skills, education, language proficiency, and work experience,” said Minister Marc Miller. Instead of making a job offer, which may not accurately represent a candidate’s credentials and prospective economic contribution, these elements are crucial in assessing a person’s capacity to contribute to Canada’s economy. making it possible for the system to become more equitable.

Potential Fraud with Job Offers

Candidates who receive an LMIA-based job offer under the existing express entry system can increase their chances of being invited to apply (ITA) by earning 50 to 200 more CRS points. Minister Miller, however, noted that this gives candidates an incentive to buy an LMIA or rig the system, providing some people with an unfair and dishonest edge. In order to resolve this and preserve the integrity of the Express Entry procedure, the government plans to remove the CRS score contribution from LMIA-based employment offers.

Labor Market Needs

The proposed policy will prioritise individuals who can contribute the most skills and expertise to Canada and its economy, even while the government recognises the importance of job offers in addressing labour shortages.

What Now?

It is crucial to remember that these modifications have not yet been formally put into effect. Depending on the job offer, candidates who have a valid LMIA-based offer as of December 18, 2024, can still receive 50–200 extra points. We’ll keep an eye on things and let you know as soon as there’s any official word.

Candidates holding an LMIA-based job offer will no longer receive these extra points if the proposed modifications are implemented. This could have an influence on their standing in the applicant pool and, consequently, their likelihood of being invited to apply (ITA).
