Partner Visa

A partner visa (820/801) allows the married or de facto spouse of an Australian citizen, Australian permanent resident or New Zealand citizen to apply for a temporary and then a permanent visa to stay in Australia. It is requested in Australia.

 

Eligibility Requirements:

  • You must be in Australia to apply for a partner visa (820/801). You must also be in a common-law relationship with your spouse or common-law partner who is an Australian citizen, permanent resident or New Zealand citizen
  • Same-sex partners can apply for this visa.
  • Most applicants must be at least 18 years old to apply for this visa.
  • Certain exceptions may apply under the Family and Immigration Act.
  • You must meet health and character requirements.

The Partner Visa (309/100) is applied for outside of Australia, and allows the married or de facto spouse to apply for temporary then permanent residence.

 

Eligibility requirements:

  • You must be in a genuine relationship with your spouse or de facto partner, who is Australian.
  • Same sex partners are eligible to apply for this Visa.
  • Most applicants must be 18 or over to apply for this Visa. Certain exemptions may apply under Family Law.
  • You do not need to be in Australia when you apply for this Visa.
  • You must meet the health and character requirements.

The Prospective Marriage Visa (300) enables prospective partners to travel to Australia when considering marriage with an Australian citizen, Permanent Resident, or New Zealand citizen. This visa is applied for before your arrival in Australia.

 

Eligibility requirements:

  • You must be sponsored by your prospective partner, who is an Australian citizen, Permanent Resident, or New Zealand citizen.
  • You must be over 18 years old.
  • You and the prospective partner must have met at least once in person before applying. At the time of meeting, both parties must have been 18 or older.
  • You must meet the health and character requirements.
  • You must be able to show that you intend on marrying your Australian partner during the period of your visa.
  • Both parties to the proposed marriage must be free to marry and must be able to be recognised under Australian law.
